McCulloch v. Maryland (1819
McCulloch v. Maryland (1819) is famous for its broad conclusions that (a), “necessary and proper” includes “all means appropriate”; and (b), that a state power to tax implies a “power to destroy.” Would American constitutional law have been better served by an opinion that reserved to the judiciary a greater role in judging the uses of national power? In other words, should the Court have set stricter limits for Congress?
