*What is the “transparency phenomenon,” and how does it relate to the prerequisite cases? (see especially pages 14-19) The first reference to this phenomenon occurs on page 16. The main discussion of the second part of the question (how it relates to the prerequisite cases) is found on page 17.
2. This question comes from the last part of chapter 3:
*What issues arose during the years 1909-1923, when there was a conflict between “common knowledge” and “scientific evidence” (as was set off by the Najour decision)? How did this conflict surface in the Shahid and Dow cases? (See especially pages 48-55, noting also the reference to Christianity on page 53.)
