John Smith worked for a small startup [25 employees] in Oakland, California. The name of the startup is WeCare, Inc. He is was employed as a software engineer for 2 years. John was laid off April 1st because of “budgetary cut backs”. John was inadvertently copied on an email between the CEO (Noah Nutting) and his former supervisory Mary Contrary. Nutting said in the email “I can’t believe how long it took to get those problem employees out of the office. We have much better working environment now that we don’t have to walk around on eggshells and being politically correct all the time.” John Smith is African American. Four employees were laid off including Smith. Two of the other former employees were Hispanic and the third a white male.
