Canadian Charter of Rights and Freedoms
My Essay Question:
2. Many of the cases we have examined required courts to balance competing Charter rights. Would this process be helped if the Supreme Court listed the Charter rights in a priority order so that people know what rights would trump other ones? If you think it would help, which rights should take priority and why? If you think it would not help explain why?
My thesis statement,
“The Supreme Court of Canada should not impose a priority order onto the Charter of Rights and Freedoms because a hierarchy of rights would predetermine court cases, resulting in the loss of due process and judicial deliberation.” I need at least 6 social science resources .
