Seen Question 1:
Victor is a national of Uralia (a fictional EU Member State) who is dissatisfied with the
state of his nation, and decides to set up a new political party, the ‘One Nation’ party.
The One Nation party advocates for the end to free movement as ‘all migration is bad
migration’; the limiting of all jobs to Uralian citizens; and the lowering of retirement
ages to 45 years old. Victor has some success in the elections of his own country and
decides to go on a tour of the other EU Member States to campaign for his worldview.
The UK (still then a Member State of the EU) bans Victor from entry into the country,
as he is considered a ‘national security risk’ following his remarks about migration.
France permits Victor entry, but on condition that he only speaks about retirement at
the age of 45, and provides him with written warning that speaking about any other
topic in public will result in immediate expulsion. Following his first lunch on French
soil, Victor publicly and bitterly complains about French food being too open to foreign
culinary influences, and is immediately expelled from France.
Upon his return to Uralia and still upset about the way he was treated by UK and
French authorities, Victor is pushing for the adoption of a new law which would result
in French nationals being unable to work in Uralia either as workers or self-employed
persons on the ground that they are not adequately skilled and which would also result
in a total ban on all beer imported from the UK on the ground that it is not pure
enough.
Victor has heard of your brilliant skills as an EU lawyer and he seeks your advice on
the following issues:
1. Can the UK ban Victor from entering into the country without violating EU free
movement law?
2. Can France set a condition upon his entry to the Member State, and where this
condition is broken can Victor be expelled for this breach without violating EU free
movement law?
3. Can Uralia ban French nationals from working there without violating EU free
movement law?
4. Can Uralia ban the importation of UK beer without violating EU free movement law?
